Spox Sox - terms of use

The following terms of use apply to all orders placed by the Customer with the Seller at www.spoxsox.pl (the ”e-store”). By using the e-store and/or placing an order, you agree to be bound by the terms of use set out herein. Please make sure you have read and understood the terms of use before placing your order.

 

§ 1 Definitions

  1. Shipping - means the physical act of supplying the Customer by the Seller, through the Operator (provider of postal or courier delivery services), the Products specified in the contract
  2. Operator – means an entity, with which the Seller cooperates, a provider of postal or courier delivery services
  3. Password - means a string of letters, digits or other symbols selected by the Customer during registration process, used to secure access to the Customer Account
  4. Customer - means the entity to whom the Seller can provide products and services and with whom the Seller can conclude an agreement
  5. Customer account – means an individual account, that a customer might create in the e-store in the registration process
  6. Terms of use – means the regulations herein
  7. Registration – means creating a customer account in the e-store. Registration is not required to place an order
  8. Seller - means Spox Sox Sp. z o.o. with its registered seat in Bielsko Biała 43-300, ul. Piłsudskiego 7, Poland. VAT number (NIP): 9372708409, REGON: 369734414, owner of the e-store
  9. Website – means a website at which the Seller runs the e-store

 

§ 2 Registration

  1. In order to register at www.spoxsox.pl, user can create an account. Registration is free of charge
  2. Registration is not required to place an order in e-store
  3. In order to register, user should fill in the registration form at www.spoxsox.pl and submit it to the Seller. User creates an individual password to his/her account
  4. User accepts Terms of use during registration process

 

§ 3 Orders

  1. The information displayed on the Website does not constitute an offer within the meaning of the Poland’s Civil Code, and only an invitation to Customers to conclude a sales agreement
  2. Please be aware that the colors of products may slightly differ from those displayed on the Website - they depend on the individual monitor settings (color saturation, and other settings)
  3. The customer can place order in the e-store via the Website or e-mail, 7 days a week, 24 hours a day
  4. To place an order on the Website a customer adds products to the shopping cart, chooses shipping and payment method, inputs shipping address and confirms order by clicking relevant button. Customer is informed about the total cost of the order before confirmation.
  5. Placing an order is equivalent to conclusion of a sale agreement between the Seller and the Customer
  6. Once you have placed your order, you will receive an email confirmation from us, which is equivalent to the Seller’s statement that we accept the conclusion of a sale agreement.

 

§ 4 Delivery

  1. Seller ships products internationally
  2. Seller provides on the Website information regarding a number of business days needed to process an order. Seller endeavours to dispatch orders in the fastest possible time and in the order in which they are placed.
  3. All orders are shipped with an Operator to an address provided by Customer in the order form
  4. Customer is obliged to carefully examine delivered consignment in the presence of an employee of the Operator. If any loss or damage to the shipment is discovered, The customer and the employee of the Operator should transcribe a proper protocol

 

§ 5 Payment

  1. The prices displayed at the Website include the statutory Value Added Tax but do not include a delivery charge and are displayed it EURO currency.
  2. The customer can choose the following payment methods:
    1. Regular bank transfer on bank account of the Seller;
    2. online transfer through Przelewy24 platform, accepting online payments and credit cards
  3. The customer is obliged to make a payment within 5 business days of the order. Otherwise the Seller has a right to cancel the sale agreement

 

§ 6 Claims and returns

  1. Seller warrants the products are free of any physical or legal defects. The seller is liable to the customer if the product has a defect (warranty)
  2. If the product has a defect, the customer has a right to:
    1. claim price reduction or withdrawal from the purchase agreement unless the seller promptly and without undue inconvenience will replace the defective product free of defects. This limitation does not apply if the product has already been replaced by the seller
    2. claim replacement of the defective products or removal of the defect. The seller is obliged to replace the defective product free of defects or remove the defect within a reasonable time without undue inconvenience to the customer
  3. The seller may refuse a compensation request of the Client, if i tis not possible to remove the defect. Replacement costs shall be borne by the Seller.
  4. The seller shall be liable under the warranty if the defect is found before the expiry of two years from the date of products delivery. The claim for the removal of defects or replacement of the product expires after one year, but the term can’t be completed before the deadline specified in the first sentence. In this period the customer can withdraw from the purchase agreement or submit a statement of the price reduction because of defects in the product. If the customer demanded replacement of the product or remedy of the defect, the deadline to withdraw from the purchase agreement or submission of a statement about the price reduction begins with the ineffective expiry of the deadline for replacement or remedy the defect
  5. Any complaints may be submitted in an electronic form at Seller’s e-mail address hello@spoxsox.pl
  6. The seller will reply to any complaints concerning products or purchase agreement within 14 days of receipt of the complaint. Seller encourages to provide photos of the product being subject of a complaint.

 

§ 7 Withdrawal from the agreement

  1. The customer may withdraw from the purchase agreement within 14 days it without giving a reason
  2. The deadline to withdraw from the purchase agreement starts from the moment of taking possession of the product by the customer.
  3. To withdraw from the purchase agreement the customer should send a statement to the Seller  in an electronic form at Seller’s e-mail address hello@spoxsox.pl
  4. In case of withdrawal from the purchase agreement, it is considered null and void
  5. Seller shall immediately, but not later than 14 days from the date of receipt of the declaration of withdrawal from the purchase agreement, pay back to consumer all payments made by him, including the shipping cost
  6. If the consumer using his right of withdrawal from the agreement has chosen a shipping method other than the cheapest offered by the Seller, the Seller is not obliged to return to the consumer additional costs incurred by him
  7. The consumer is obliged to return products to the Seller immediately, but no later than within 14 days from the withdrawal date. To meet the deadline consumer shall just send products to the Seller's address before the expiry of that period
  8. The consumer withdrawing from the Agreement bears only the cost of returning the Product to the Seller
  9. The Seller shall refund the value of the product, including the costs of its delivery using the same method of payment, which was used by a consumer, unless the consumer has agreed to a different way of return

 

§ 8 Final provisions

  1. Seller undertakes the protection of personal data of the customer in accordance with the Act of August 29, 1997. On the protection of personal data
  2. Each customer will be informed about any changes to this Terms of use, by an information displayed on the Website, summarizing the amendments to the Terms of use
  3. In the case of non-compliance of any part of the Terms of use with the applicable law, the relevant provisions of Polish law should be applicable
  4. In matters not covered by the provisions of the Terms of use, apply the provisions of the Act of 23 April 1964. Civil Code (Dz. U. of 1964. No. 16, pos. 93, as amended. D.), The Act of 22 July 2002 . on electronic services (Dz. U. of 2002. No. 144, item. 1204, as amended) and - in the case of consumers - the Law of 2 March 2000. on the protection of consumer rights and liability for damage caused by dangerous products (Dz. U. of 2000. No. 22, item. 271, as amended)

I.    GENERAL CONDITIONS

  1. Spox Sox works to ensure that your privacy is protected when using our services. We therefore have a policy setting out how your personal data will be processed and protected
  2. An administrator and controller of your personal data you submit to us during registration or ordering process is Spox Sox Sp. z o.o. with its registered seat in Bielsko Biała 43-300, ul. Piłsudskiego 7, Poland. VAT number (NIP): 9372708409, REGON: 369734414, e-mail: hello@spoxsox.pl, (the “Administrator”)
  3. Your personal data are being processed according to the Polish Data Protection Act of 29.08.1997 (Dz. U. Nr 133, poz. 883), as well as the Polish Act on Rendering Electronic Services as of 18.07.2002 (Dz. U. Nr 144, poz. 1204)
  4. The Administrator puts effort in protecting the interests of persons, who submit their personal data to us. Administrator, in particular, ensures that the collected data are processed in accordance with the governing laws; data are collected for specified, legitimate purposes (to process an order) and are not subjected to further processing incompatible with those purposes; relevant and adequate in relation to the purposes for which they are processed and stored in a form which permits identification of the persons that data concern and for no longer than is necessary to achieve the purpose of processing
  5. Any words or phrases written in the content of this Privacy Policy with a capital letter shall be construed in accordance with their definitions in the Terms of Use 

 

II.    THE PURPOSE AND SCOPE OF DATA COLLECTION

  1. Personal data of Customers collected by the Administrator, are used for accounting purposes, for marketing purposes, contacting Customers and other activities related to the performance of the Sale/Purchase Agreement
  2. Administrator processes the following personal data of the Customers:
    a)    First and last name, Company name
    b)    Address (Street number, Zip/postal code, City and Country)
    c)    Telephone number
    d)    VAT number (for Companies)
    e)    E-mail address
  3. Submission of the above mentioned personal data is necessary to provide electronic services by us and to conclude a Sale/Purchase Agreement
     

III.    THE BASIS FOR DATA PROCESSING

  1. Using our E-store, concluding agreements for delivery of electronic services via the E-store or entering into Sale/Purchase Agreement, which involves the need to enter personal information is entirely voluntary. A person providing his/her personal data independently decides whether to start using the services provided electronically by Spox Sox or enter into a Sale/Purchase Agreement in accordance with the Terms of Use
  2. According to art. 23 of the Polish Data Protection Act of 29.08.1997 data processing is permitted, among others, if:

a) a person, the data relates to, gives consent to process his/her data, unless the erasure of the data is concerned

b) it is necessary to perform the contract, when a person, the data relates to, is a party of such contract or when it is necessary to take actions before the conclusion of the agreement on the request of the person, the data relates to

  1. Processing of personal data by the Administrator always takes place within the permissions stated in paragraph 2. In addition, before placing an order in the E-store and conclusion of a Sale/Purchase Agreement a prospective Customer is always informed about the requirement to accept the Terms of Use


IV.    RIGHT TO CONTROL, REQUESTING INFORMATION, ACCESSING AND AMENDING PERSONAL DATA

  1. The Customer has the right to request information about the personal data we hold on him/her at any time. If data is incorrect, incomplete or irrelevant, the Customer can ask to have the information corrected or removed
  2. We cannot remove Customer’s data when there is a legal storage requirement or when there are other legitimate grounds to keep the data

V.    FINAL PROVISIONS

  1. The administrator uses technical and organizational measures to protect personal data processed appropriately to the risks and category of data being protected. In particular, the Administrator protects data against their unauthorized disclosure, takeover by an unauthorized person, processing with the violation of existing regulations or unauthorized change, loss or damage
  2. The Administrator provides the following technical measures to prevent the acquisition and modification by unauthorized persons personal data transmitted electronically:
    a) Data encryption for authentication
    b) Protection of the data base against unauthorized access
  3. In cases not covered by this Privacy Policy the provisions of the Terms of Use and other relevant provisions of the Polish law shall apply
